Terms of the Distance Contract

“ANIMALS DIGITAL” Ltd., Rožupītes, Plakanciems, Ķekavas novads, LV-2113, hereinafter referred to as the “online store,” provides the content available on the website and supplies goods and services in accordance with the Terms of Use set out below.

1. General Terms

If a consumer purchases goods/services through the website, such mutual agreement shall be considered a Distance Contract and shall be subject to the legal provisions of the Republic of Latvia governing distance contracts, including but not limited to the Consumer Rights Protection Law of the Republic of Latvia, the Regulations of the Cabinet of Ministers of the Republic of Latvia “Regulations on Distance Contracts,” and other relevant legislation.

2. Placing an Order

The prices and specifications of the products sold in the online store are indicated next to the products.

By entering the required information and placing an order, the Buyer confirms that they have read and agree that the data they provide will be used so that the Seller can accept the Buyer’s order and carry out delivery in accordance with the requirements of applicable legislation. By entering this information, the Buyer agrees to receive notifications related to the processing of their order at the email address provided.

To place an order, add the desired products to the shopping cart. Fill in all required fields and select the most suitable delivery method. The total cost of the order, including delivery, will then be displayed on the screen. Complete payment for the purchase to finalize the order.

Order fulfillment takes 5–10 business days, depending on the delivery method selected. The Seller undertakes to present the parameters and specifications of the offered goods in a detailed and transparent manner.

The Seller has the right to publish images of finished, made-to-order products on www.sharkness.eu, unless the Buyer has submitted a written or verbal request opposing the publication of images of the products they ordered.

3. Payment Terms

The currency used for payments on the website is the euro. Purchases can be paid for using the following payment methods, provided by the payment platform makecommerce.lv, Maksekeskus AS:

Latvian internet banking payments: Swedbank, SEB, Citadele, and Luminor, as well as Visa/Mastercard card payments. When using the internet banking payment method, confirm the order and click the “Return to merchant” button.

Personal data required for processing payments is transferred to the licensed payment institution Maksekeskus AS.

The contract takes effect upon successful payment to the online store’s bank account. If, for any reason, the order cannot be fulfilled, the Buyer will be notified, and the amount paid will be refunded as soon as possible, but no later than within 14 days of receiving the notification.

4. Delivery Terms

Goods are delivered within the territory of Latvia using Omniva parcel lockers and courier services. All duties and taxes payable to receive the shipment at its delivery destination must be covered by the Buyer. Delivery costs are displayed before the order is confirmed. Purchased goods are delivered to the address specified by the Buyer within 2–4 business days. In exceptional cases, we reserve the right to ship the goods within up to 45 calendar days, with the customer being informed accordingly.

The contract takes effect upon successful payment to the online store’s bank account. If, for any reason, the order cannot be fulfilled, the Buyer will be notified, and the amount paid will be refunded as soon as possible, but no later than within 14 days of receiving the notification.

5. Right of Withdrawal

The Buyer has the right to withdraw from the purchase within 14 calendar days from the moment of receiving the Product. (Depending on the product, the Buyer may not have a mandatory right of withdrawal; in such cases, the reason must be clearly stated and explained.) The right of withdrawal does not apply if the Buyer is a legal entity.

In order to exercise the 14-day right of withdrawal, the goods may only be used for their intended purpose, and the consumer is responsible for maintaining the quality and safety of the product during the withdrawal period. If the goods have been improperly used or damaged, handled negligently during use, or used without following the instructions, or if the original packaging has been lost, or if the packaging has been significantly damaged, the online store has the right to reduce the refundable amount in proportion to the decrease in the product’s value.

To exercise the right of withdrawal, you must submit a withdrawal form, which can be obtained upon request by sending an email to info@sharkness.eu within 14 days of receiving the goods.

The Buyer covers the costs of returning the goods, except in cases where the reason for the return is that the product does not match the order (for example, an incorrect or damaged product).

The Buyer is obliged to return the Products to the Seller without delay, but no later than within 14 days of sending the withdrawal form to the online store. Upon receiving the returned goods, the online store will, without delay, but no later than within 14 days, refund all payments received from the Buyer based on the Distance Contract.

The Seller has the right to withhold the refund until the Products or confirmation of the return of the goods has been received from the Buyer. If the Buyer has chosen a delivery method other than the cheapest one offered by the online store, the online store is not obliged to compensate for the additional shipping costs incurred.

The online store is not liable for delays in fulfilling its obligations, or for failure to fulfill them, or for any other type of non-performance arising from circumstances and obstacles beyond the online store’s reasonable control.

The online store reserves the right to refuse to sell goods and to request the return of goods from the Buyer if the price indicated on the online store is significantly lower than its market price due to an error.

The contract takes effect upon successful payment to the online store’s bank account. If, for any reason, the order cannot be fulfilled, the Buyer will be notified, and the amount paid will be refunded as soon as possible, but no later than within 14 days of receiving the notification.

6. Consumer Rights Regarding Non-Conforming Goods

The online store is liable for any non-conformity of the goods sold to the Buyer with the terms of the contract, or for defects that arise within 6 months from the date of delivery of the goods to the customer, or that existed at the time of delivery, provided that such an assumption is not inconsistent with the nature of the item or the defect itself. The Buyer must inform the Seller of any non-conformity of the goods without delay, within 2 months of discovering it — i.e., must submit a complaint. The Buyer may submit a complaint by contacting the online store via email at info@sharkness.eu.

The online store is not liable for defects that arise after the goods have been delivered to the Buyer. If the purchased goods have defects for which the Seller is responsible, the Buyer has the right to request that the defects be remedied or that the goods be exchanged for new ones free of charge.

If it is not possible to repair or replace the goods, the Seller will refund the Buyer all payments provided for under the Distance Contract. The Seller will provide a written response to the consumer’s complaint within 15 days.

7. Processing of the Buyer’s Personal Data

The online store processes only the personal data that the Buyer has entered when placing an order, such as first name, last name, email address, etc.

The online store transfers personal data to the transport service provider(s) in order to ensure delivery of the goods.

If you have explicitly consented to receive our marketing communications, including newsletters, we may occasionally contact you with information about our services and the latest offers. For this purpose, we may process the email address you provided when subscribing to marketing communications. The Buyer has the option to opt out of marketing communications by notifying us via email at info@sharkness.eu.

8. Dispute Resolution Procedure

On matters not addressed in these terms and conditions, the Buyer and the Seller undertake to comply with the legislation in force in the Republic of Latvia.

The Parties shall resolve any disputes arising between the Seller and the Buyer through mutual negotiation or correspondence. If a dispute cannot be resolved through negotiation or correspondence, the Parties shall resolve the dispute in the courts of the Republic of Latvia, in accordance with the legislation of the Republic of Latvia. Disputes between the Buyer (consumer) and the Seller may also be referred to the Consumer Rights Protection Centre or to the courts of the Republic of Latvia.

The Buyer also has the right to turn to the dispute resolution bodies of the European Union.
